    By downloading, installing, or using this augmented reality application (“App”), you agree to be bound by these terms. This app is provided “as is” without warranty of any kind.
  2. ASSUMPTION OF RISK & USER RESPONSIBILITIES
    By using this app, you acknowledge that participation involves real-world activity in an outdoor environment and that you use the app entirely at your own risk. Use the app responsibly and stay aware of your surroundings at all times. Stay on paths, follow park rules, and respect others’ privacy and property. Avoid hazards like stairs, ledges, or water. Never use the app while driving or walking near traffic. Stop immediately if you feel dizzy or unwell. Children must be supervised.
  3. DEVICE REQUIREMENTS
    Camera and location permissions are required for the App to function properly. Compatibility with all devices or operating systems is not guaranteed. Periodic updates may be necessary to maintain full functionality.
  4. PRIVACY AND DATA COLLECTION
    We do not collect, store, or transmit any personal data, images, or location information from your device. This App only requires your camera and location services to display augmented reality content at specific points in the park. Camera access is used solely to render AR objects in real time on your screen. Photographs taken with the App are stored only on your device.
  5. AGE RESTRICTIONS
    App is intended for users aged 13+. Parental supervision required for younger users.
  6. LIMITATION OF LIABILITY
    To the fullest extent permitted by law, we are not responsible for any direct or indirect issues that may arise from using this App, including personal injury or property damage, loss of data, device malfunction, or service interruptions.
  7. INDEMNIFICATION
    You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, affiliates, agents, partners, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses (including attorneys’ fees and legal costs), or demands arising from or related to:
    Your use or misuse of the App
    Your violation of these Terms
    Your violation of any law, regulation, or third-party rights
    Any unsafe, negligent, or prohibited use of the App
    Any injury, death, or property damage caused by your use of the App
    Any disputes with other users or third parties
  8. GOVERNING LAW AND JURISDICTION
    These Terms shall be governed by the laws of the State of New York, without regard to conflict of law principles. You agree that any disputes shall be resolved exclusively in the courts of New York and you consent to the jurisdiction of such courts.
